Operating Boat While Under Influence Michigan

Operating a Motorboat While Under the Influence is operating a motorboat with a blood alcohol content (BAC) of .08% or greater or under the influence of alcohol or a controlled substance.

The first offense of boating under the influence is a misdemeanor punishable by one or more of the following:

  • Up to 93 days in jail
  • A fine of $100 to $500
  • Community service for not more than 45 days

The owner of a motorboat or person in charge or in control of a motorboat may also be charged with a crime for authorizing or knowingly permitting someone to operate a motorboat while under the influence of alcohol or a controlled substance. This is also a misdemeanor punishable by one or both of the following:

  • Up to 93 days in jail
  • A fine of $100 to $500

Multiple Offenses of Operating a Motorboat While Under the Influence

If an individual is convicted of Operating a Motorboat While Under the Influence two times within seven years, he or she is guilty of a misdemeanor punishable by one or more of the following:

  • 48 consecutive hours to 1 year in jail
  • Community service for 10 to 90 days

Third Offense Operating a Motorboat While Under the Influence is a felony punishable by one or more of the following:

  • 1 year to 5 years imprisonment
  • A fine of $500 to $5000
